UPDATE: The SEC’s Marketing Rule is Officially Published – What Now?

WHAT HAPPENED?

On Friday, March 5, 2021, the U.S. Securities and Exchange Commission’s highly anticipated Marketing Rule was published in the Federal Register, setting in motion a series of regulatory requirements for investment advisers. The move to officially publish the Rule had previously been delayed due to a regulatory freeze instated by the Biden administration.

The vast majority of SEC-registered investment advisers will be impacted by the Rule and will be required to change their policies and procedures for marketing and solicitation.

IMPORTANT DATES

Investment advisers should remain aware of several important dates regarding the Marketing Rule:

  • The Marketing Rule was published in the Federal Register on March 5, 2021
  • The effective date for the Rule is May 4, 2021
  • The compliance deadline for the Rule is November 4, 2022
